What is the EU Data Act?

In line with the EU Data Act, which aims to ensure fair access to, and transparent use of data generated by connected products, we provide clear information about how our SMART products generate, process, and make data accessible to users.

“SMART products” are defined as Qlima devices that incorporate connectivity technologies (such as integrated Wi-Fi modules) enabling them to generate, collect, and transmit data. These products can connect to external platforms or applications to facilitate remote monitoring, control, and data-driven functionalities.

The EU Data Act is a European regulation designed to create a fair, transparent, and innovative data economy. It gives both consumers and businesses more control over the data generated by connected products, such as smart devices and Internet-of-Things (IoT) solutions. The regulation ensures that users have access to the data their devices generate, can share this data with third parties if desired, and are not locked into a single service provider. It also promotes interoperability between services and fair conditions for data sharing. At the same time, it promotes responsible data use, protects confidentiality, and supports innovation across industries.

At Qlima, we support these principles and aim to provide full transparency about how our SMART products generate and handle data, while ensuring that users retain control over the data generated by their devices.

Information regarding the EU Data Act and our products

The data that is stored within the SMART devices used on Qlima products consists mostly of device statistics such as device history, the circumstances during which it was used (weather, humidity, etc.), error codes/logs, sensor performance, alarms, and device status updates. The data stored is technical and operational and does not include personal information. This means the data falls within the scope of non-personal, product-generated data as defined under the Data Act.

Our products using SMART modules can generate data continuously and in real time. They do so by monitoring statistics and tracking device history, location and providing real-time energy monitoring updates. This allows consumers to gain real-time insights and supports improved product performance and efficiency. In line with the Data Act, this data can provide value to users by enabling better use, maintenance, and optimisation of the product. Depending on the WiFi module, consumers can access and manage this data through apps such as Smart Life (Tuya) or Nethome. This ensures that the user can review past device activities and logs. By providing access through these platforms, we support the principle that users should be able to access and use the data generated by their connected devices.

Users can access and manage their data via the associated mobile application or platform connected to their device (such as Smart Life or Nethome). Through these applications, users can view device activity, extract relevant data, and manage or delete their information where applicable. Access to data is structured to ensure security and appropriate user rights: individual users can access their own data, while certain device-related data may be restricted to the designated administrator of the device or household. Users are also able to delete their data and account through the respective application. When an account is deleted, the associated data is removed within a defined period.

This approach reflects key Data Act principles, including user access to data, the ability to control and share data, and transparency in how data is handled.

Please note that Qlima does not store any of the data generated by SMART products. This data is stored by third-party providers such as Tuya or Nethome. Qlima acts as the product provider, while these parties operate as the data hosting and platform providers. Our SMART modules connect directly to these platforms using the integrated Wi-Fi modules, used to control and operate the devices. This clear separation of roles supports transparency in the data value chain and is encouraged by the Data Act.
